RIGHT TO ACCESS INFORMATION

The right to access information and reuse information is exercised in accordance with the Law on the right to access information ("Official Gazette", number 25/2013 and 85/15).

The aim of the Act is to enable and ensure the realization of the right to access to information guaranteed by the Constitution of the Republic of Croatia, as well as to the reuse of information by natural and legal persons through the openness and publicity of the actions of public authorities.

The right to access information is based on the principles of publicity and free access, timeliness, completeness and accuracy of information, the principle of equality, the principle of information disposal and, in accordance with Article 5, paragraph 1, point 5 of the Act, "encompasses the user's right to seek and obtain information, as and the obligation of the public authority to provide access to the requested information, i.e. to publish information independently of the request when such publication results from an obligation determined by law or other regulation".

Information , in the sense of the aforementioned Law (Article 5, Paragraph 1, Point 3), represents "any information that is possessed by a public authority in the form of a document, record, file, register or in any other form, regardless of the way in which it is presented (written, drawn, printed, recorded, magnetic, optical, electronic or any other record)."

The right to access information is exercised by submitting a request to SB Naftalan, information officers of SB Naftalan:

When submitting the application, it is not necessary to pay an additional fee with the form.

A request for access to information, in order to be valid, must contain:

  • the party's statement that it refers to the Law on the Right to Access to Information,
  • name and headquarters of the public authority to which the request is submitted,
  • requested information (data that is important for identifying the requested information),
  • first and last name and full residential address of the natural person submitting the application,
  • the company, i.e. the name of the legal entity and its headquarters,

The applicant is not obliged to state the reasons for which he is requesting access to the information, and in the request he can also propose the way in which the public authority will make the information available.

Incomplete requests cannot be referred to the procedure.
